Trattamento dei dati personali dei lavoratori nell’ambito dell’emergenza sanitaria

Il Garante per il trattamento dei dati personali ha espresso orientamenti circa misure previste dal Protocollo 24 aprile 2020 per contenere la diffusione del virus COVID-19. È fatto divieto al datore di lavoro di registrare il dato afferente alla temperatura corporea del lavoratore ove questa sia inferiore ai 37,5°.

Modifica degli assetti proprietari e strumenti dai quali possa derivare il controllo a distanza dell'attività dei lavoratori

L'INL con lettera circolare del 25 febbraio 2019 n. 1881 ha stabilito che il mero "subentro" di un'impresa in locali già dotati degli impianti audiovisivi o altri strumenti dai quali derivi anche la possibilità di controllo a distanza dell’attività dei lavoratori non integra di per sé profili di illegittimità qualora gli impianti/strumenti stessi siano stati installati osservando le procedure (accordo collettivo o autorizzazione) previste dall’art. 4 della L. n. 300/1970 e non siano intervenuti mutamenti riguardo i presupposti legittimanti e le modalità di funzionamento.

Legislative Decree no. 101 of 10 August 2018

Legislative Decree no. 101 of 10 August 2018 was published by the Council of Ministers in Official Gazette no. 205 of 4 September 2018. This decree contains the provisions for adapting the national legislation to EU Regulation no. 2016/679 of the European Parliament and of the Council of 27 April 2016, relating to the protection of natural persons on the processing of personal data, and on the free movement of such data and repealing EC Directive 95/46 (General Data Protection Regulation).

The decree makes significant changes to Leg. Decree no. 196 of 30 June 2003 and will come into force on 19 September 2018.

Installation of audio-visual equipment, faster authorisations

The National Labour Inspectorate has issued operating instructions so that the authorisations are issued in absolutely rapid times if video cameras or photo cameras are activated exclusively with the alarm system inserted, since there is no possibility of “preintentional” control over the personnel and, therefore, no reasons to obstruct the granting of the authorisation.

Processing of judicial data of employees

The Privacy Authority intervened on the employer’s legitimacy to request an employee’s criminal record at the time of employment. Specifically, the Authority stressed that the employer’s request for the criminal record may be provided for certain tasks or specific cases, identified exclusively by law or collective bargaining .

European Regulation on Personal Data

The Plenary Assembly of the European Parliament adopted EU Personal Data Protection Regulation no. UE 679/2016. The provisions of the Regulation did not become immediately applicable from 24 May 2016 but from that day, the two-year period within which all Member States are required to adapt their national privacy laws to the regulatory requirements. From the same date, Directive 95/46/C will be repealed.
